Welcome to Folafy. Folafy is a Software-as-a-Service (SaaS) creator-commerce platform designed to empower creators, freelancers, agencies, businesses, and professionals with digital tools to build, launch, and monetize their online presence.

Folafy provides an integrated suite of tools including portfolio and website builders, digital storefronts, media management systems, creator commerce capabilities, messaging, and subscription-based billing infrastructure. The platform operates as a technology infrastructure and platform provider.

These Terms of Service govern your access to and use of the Folafy platform, products, services, websites, APIs, and associated tools. By registering, accessing, or using any part of the Platform, you agree to be legally bound by these Terms.

To be eligible to use the Folafy Platform, you must be at least 18 years of age. Persons under the age of 18 are strictly prohibited from registering as account holders or creating storefronts.

You must possess the legal capacity to enter into a binding contract under applicable laws, and you must not be barred from receiving services under applicable laws in India or any other jurisdiction. Folafy reserves the right to verify eligibility at any time.

You must create an account by providing accurate, current, and complete information. You are solely responsible for maintaining the confidentiality of your account credentials, including your username and password, and must not share your credentials with any third party.

You must not create accounts using false, misleading, or fraudulent identities, impersonate any person, or use automated tools to create accounts. Folafy reserves the right to suspend or terminate any account where it suspects fraudulent registration or abuse.

Folafy offers subscription-based access plans for Creators. Current plan tiers include the Seed Plan (entry-level), Sapling Plan (mid-tier), and Tree Plan (advanced plan designed for professional creators).

Subscriptions are available on monthly or annual billing cycles. All subscription plans are set to auto-renew at the end of each billing cycle unless cancelled prior to the renewal date. Folafy may offer free trial periods; at the conclusion of a trial period, your selected plan will automatically convert to a paid subscription unless you cancel before the trial ends.

Users retain ownership of all content they upload, create, or share on the Folafy Platform, including original works, digital products, and creative assets listed by Creators.

By uploading content to the Platform, you grant Folafy a worldwide, royalty-free, non-exclusive, sublicensable license to host, store, cache, reproduce, display, distribute, optimize, and deliver such content solely for the purpose of operating and improving the Platform. This license does not grant Folafy the right to sell or commercially exploit your content beyond platform operation.

The following content is strictly prohibited on the Folafy Platform: illegal content under applicable laws, malware, viruses, phishing tools, pirated content, copyright-infringing materials, hate speech, adult explicit content, and counterfeit goods.

Prohibited activities include attempting to circumvent Platform fees, scraping or data-mining the Platform without authorization, interfering with Platform security, engaging in market manipulation, and using the Platform to distribute spam.

Folafy reserves the right, at its sole discretion, to suspend, restrict, or permanently terminate any account, without prior notice, in circumstances including but not limited to violations of these Terms of Service.

Accounts may be suspended for fraudulent activity, distribution of prohibited content, repeated copyright infringement, non-payment of subscription fees, or suspected illegal activity. Users may also cancel their Folafy subscription and request account closure at any time.

To the fullest extent permitted by applicable law, Folafy and its service providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of revenue, profits, business opportunities, data, or goodwill.

Where liability cannot be fully excluded under applicable law, Folafy's total aggregate liability to any user shall not exceed the greater of the amount paid by that user to Folafy in the three (3) months preceding the claim, or INR 5,000.

Folafy's collection, use, and protection of personal data is governed by the Folafy Privacy Policy, which is incorporated by reference into these Terms. Folafy collects data necessary to provide the Platform services and does not sell user personal data to third-party data brokers or advertisers.

User data is shared only with service providers necessary for platform operation, under appropriate data processing agreements.

These Terms of Service and any dispute arising from them shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

Any legal proceedings or disputes shall be subject to the exclusive jurisdiction of the courts located in India. For international users, additional consumer protection laws may apply depending on jurisdiction.
